Elon Musk, the tech billionaire, is offering to give away $1 million (£766,000) every day to a randomly selected voter in key battleground states until the U.S. presidential election on November 5. The giveaway is part of Musk’s campaign group, AmericaPAC, which he started to support Donald Trump’s return to the White House.

The contest is open to voters in important states like Pennsylvania, Georgia, Nevada, Arizona, Michigan, Wisconsin, and North Carolina—states that could decide the outcome of the election.

To enter, voters need to sign a petition supporting the U.S. Constitution, including issues like free speech and gun rights. The first $1 million check was given to a surprised voter at a town hall event in Pennsylvania on Saturday night, with another winner announced on Sunday.

Musk’s offer has caused concern among some officials and experts. Pennsylvania Governor Josh Shapiro, a Democrat supporting Kamala Harris, called the giveaway “deeply concerning” and suggested law enforcement should investigate it.

Election law expert Rick Hasen also raised legal concerns, saying the offer might be illegal. Under U.S. law, it’s illegal to pay people to vote or register to vote. Hasen pointed out that the petition is only for registered voters in key states, which could make the offer unlawful.

By signing the petition, voters provide their contact details, which could allow Musk’s group, AmericaPAC, to contact them about their voting preferences. So far, neither Musk nor his campaign group has commented on the controversy.

In Pennsylvania, voters are being offered $100 for signing the petition and another $100 for every person they refer who also signs. In other battleground states, voters get $47 for each referral.

Although U.S. law bans paying people to vote, some believe Musk’s campaign may have found a loophole. Instead of paying people to vote directly, they’re being paid to sign a petition.

This strategy could bypass the law but still raise ethical questions. In 2008, ice cream company Ben & Jerry’s had a similar issue when they offered free ice cream to people who had voted, leading them to give ice cream to everyone to avoid breaking the law.

When asked about Musk’s plan, Trump said he wasn’t closely following it but mentioned that Musk is a “friend” and that they talk regularly.

Musk, who founded companies like Tesla and SpaceX and owns X (formerly Twitter), has been a strong supporter of Trump’s campaign. He started AmericaPAC in July and has already donated $75 million (£57.5 million) to support Trump.

AmericaPAC’s website says the group is focused on key issues like secure borders, safe cities, sensible spending, fair justice, free speech, and gun rights. Musk said he hopes to get over a million voters in battleground states to sign the petition to show their support for the First and Second Amendments. He added, “I think it sends an important message to our politicians.”

Musk, the world’s richest person with a net worth of $248 billion (£191 billion), according to Forbes, has made a big impact on the election with his financial support. However, his giveaway has sparked legal and ethical questions that could affect the final weeks of the campaign.
