Federal Judge Stops Trump Admin from Banning Transgender People from the Military

A federal judge on Wednesday rejected the Trump administration’s request to end an order that stops a military policy banning transgender people from enlisting. The policy was set to go into effect on Friday, but Judge Ana Reyes, a Biden appointee, kept the injunction in place.

At a hearing on March 21, Judge Reyes allowed more time by delaying the Department of Defense’s March 26 deadline for the ban. In their request, Trump officials—including Defense Secretary Pete Hegseth—argued that the policy does not ban transgender people overall but only looks at “gender dysphoria,” a medical condition. They said this is similar to how other conditions are regulated.

The government also asked the judge to keep the injunction in place while they appeal her decision. They pointed to new guidance issued on March 21 that explains the policy applies only to those who show symptoms that meet a diagnosis for gender dysphoria.

Judge Reyes, however, said more time is needed for the appeals process. She noted that while the new guidance is different, the main argument has not changed. She explained that only transgender people experience gender dysphoria, making it a unique issue.

Adding fuel to the fire, Defense Secretary Hegseth made a controversial comment on social media, suggesting that Judge Reyes should report to military bases and train troops. This remark sparked more criticism.

Some Republican lawmakers have warned that sharing sensitive military details on a commercial app is a serious mistake. Senate Armed Services Committee Chair Roger Wicker and Sen. Jack Reed said they would ask the Defense Department for a quick investigation and a classified briefing on the matter.

The Trump administration has filed a notice of appeal with the U.S. Court of Appeals for the District of Columbia. The case comes at the same time that the Supreme Court is looking at another case involving transgender rights for minors.

Judge Reyes ended her remarks by thanking U.S. service members and urging everyone to keep working for the safety and fairness of the country.
