Why Diddy Says He Should Be Released on Bond in Explosive New Court Filing

Music mogul Sean “Diddy” Combs is facing a potential 20-year prison sentence after being found guilty on two counts of violating the Mann Act, a century-old federal statute that criminalises the transport of individuals across state lines for prostitution or “immoral purposes.”

While Diddy was acquitted of more serious racketeering charges, the verdict still places the 55-year-old entertainer in serious legal jeopardy. His legal team, however, insists the conviction is a misapplication of the law and have argued for his release pending sentencing.

“There has literally never been a case like this one,” Diddy’s attorneys said in a statement obtained by The Root, referring to the Mann Act. They argue that Combs’s conduct was consensual and rooted in the “swingers lifestyle,” not criminal behaviour.

In court filings, his legal team cited past intimate relationships, including one with singer Cassie Ventura, as evidence of consensual adult activity. “Cassie Ventura and Diddy went to swingers clubs and had threesomes. Ms. Ventura consistently expressed interest and enthusiasm,” the document read. It also referenced similar encounters involving another woman identified only as “Jane.”

Despite those claims, U.S. District Judge Arun Subramanian has repeatedly denied motions for early release. The judge cited concerns about Combs’s wealth, influence, and access to resources, stating they could pose a threat to public safety or facilitate flight.

During the trial, Combs’s attorneys acknowledged his violent past but pointed to his completion of therapy and domestic violence education courses as evidence of reform.

A proposed bail package includes a $50 million bond secured by Combs’s Florida estate and assurances from three financially responsible individuals. His lawyers also said he would remain confined to his Miami residence and surrender his passport, only traveling to New York for sentencing.

“If released on conditions, Sean Combs will not be violent to anyone,” his legal team argued. “This jury gave him his life back, and he will not squander his second chance—nor would he risk leaving his seven children without a father.”

As of now, Judge Subramanian has yet to rule on the bail motion, leaving Diddy in custody while he awaits sentencing.
